Notification of proposed changes to GRF Governing Documents

MEMBER SERVICES 37-1447-1 Use of Community Facilities, Community Gardens Rules PLEASE TAKE NOTICE that at a duly held meeting of the Board of Directors conducted on September 24, 2024, the Board approved to send out the following proposed rule change to the membership for 28-day review. The proposed rule change will be reviewed by the Board for adoption at their October 22, 2024. Text of Proposed Rule Change: 2.25. No water features are permitted. 2.38. No golf carts are allowed to drive on garden portion or walkway areas. Golf carts must remain on the street.

Purpose and Effect of the Proposed Rule Change: The proposed rule change is to enhance water conservation, safety, and protection of garden areas.

PLEASE TAKE FURTHER NOTICE that, Association members owning 5% or more of the separate interest in the Association may call a special vote of the members to reverse the proposed rule change by delivering a written request to the Association for said vote within the 30 days after the delivery of this notice. Not less than 35 days, nor more than 90 days after the receipt of a proper request for a special vote on the proposed rule change, the Association shall hold a vote of the members on whether to reverse the proposed rule change. As soon as possible after the close of voting, but not more than 15 days after the close of voting, the board shall provide the members with general notice of the results of the member vote on the proposed rule change.

ADMINISTRATION 14-5061-2, Residency & Trust Property Use Fess PLEASE TAKE NOTICE that at a duly held meeting of the Board of Directors conducted on September 24, 2024, the Board approved to send out the following proposed rule change to the membership for 28-day review. The proposed rule change will be reviewed by the Board for adoption at their October 22, 2024. Current Rule: 1.4. The TPUF is calculated as twenty-five (25) times the monthly GRF 18 assessment and rounded up to the nearest dollar. The TPUF is reviewed annually, and Any changes of rates are implemented on January 1st of each year.

1.6.1. Divided monthly on a percentage basis between the Reserve and Capital Funds according to the current budget year document.

1.6.2. All amounts in excess of the allocation to the reserve Fund specified in the current budget year document are allocated to the Capital Fund.

Text of Proposed Rule Change: 1.4. The TPUF is determined annually by the Board of Directors in conjunction with the budget. Any changes of rates are implemented on January 1st of each year.

1.6.1. Divided monthly between the Reserve, Contingency, and/ or Capital Funds according to the current budget year document.

1.6.2. All amounts in excess of the allocation to the Reserve Fund and Contingency Fund as specified in the current budget year document are allocated to the Capital Fund.

Purpose and Effect of the Proposed Rule Change: The proposed rule change is to adjust the fee to meet the community’s financial needs while ensuring the upkeep and improvement of community facilities. Additionally, the proposed changes add the ability to allocate the TPUF to the operating contingency fund, in addition to the reserve and capital funds. This change is intended to improve the organization’s cash position by providing additional resources to address unforeseen expenses or cash flow needs, thereby strengthening the organization’s financial resilience.
